IRDAI Master Circular (29 May 2024, Ref: IRDAI/HLT/REG/CIR/06/2024)

Capped at 36 continuous months (3 years) across all retail health policies. Insurers cannot enforce earlier 4-year (48-month) waiting periods.

Key Waiting Period Rules Under IRDAI Master Circular 2024

1. 36-Month Max Cap on Pre-Existing Conditions

Effective 2024, IRDAI reduced the statutory waiting period for Pre-Existing Diseases (PED) from 4 years (48 months) to 3 years (36 months). Even if older policy wordings mention 4 years, statutory regulations override policy wording.

2. Full Continuity on Policy Portability

Under IRDAI Portability Regulations, when you transfer your health policy from Insurer A to Insurer B, your accumulated waiting period credits transfer 100% to the sum insured of the previous policy. The new insurer cannot reset your waiting clock.

3. Moratorium Period Reduced to 5 Years

IRDAI reduced the moratorium period from 8 years to 5 continuous policy years (60 months). After 5 years of continuous renewals without a break, no claim can be rejected on the grounds of non-disclosure or misrepresentation, except proven deliberate fraud.

4. Supreme Court Precedent (Manmohan Nanda Case)

In Manmohan Nanda v. United India Assurance (2022), the Supreme Court ruled that once an insurer accepts a proposal after underwriting and collects premium, it cannot mechanically repudiate claims for ordinary pre-existing ailments unless active fraud is established.
