Statutory Rules Governing Rejection Deadlines

Can an insurer delay replying beyond 30 days?

No. Under Regulation 10(2) of IRDAI Policyholder Protection Regulations, an insurer cannot stall. If 30 calendar days pass without a response, the policyholder is legally entitled to proceed to the Insurance Ombudsman without waiting any longer.

What is Rule 14(3)(b) of Ombudsman Rules?

It specifies that no complaint to the Ombudsman shall lie unless the complaint is made within one year from the date of receipt of the order of the insurer rejecting the representation. The Ombudsman can award up to ₹50 Lakh plus penal interest.

Is there any fee to file with the Ombudsman?

None. Filing a complaint with the Insurance Ombudsman is 100% free. No court fees, no advocate fees, and no stamp duty are required. The process is informal and user-friendly.

Can I file if I only received partial settlement?

Yes. Unlawful deductions (such as room rent proportionate cuts or non-medical consumable deductions) are treated as partial repudiation. The 30-day GRO and 1-year Ombudsman rules apply identically.
